It asks, first, whether such appointments ought to continue to be made and, secondly, whether they are constitutionally permissible. The appointment of senior judges to vice-regal roles has a long history in Australia. A Chief Justic e or Justice of the High Court has opened the first sitting of every federal parliament since 1904 and, in the states, the practice of appointing the Chief Justice of the state Supreme Court as Lieutenant-Governor dates back to at least the 1860s"-- Executive summary.
