After the Second World War, the international Tokyo Tribunal put 25 Japanese wartime leaders on trial for "Class A" war crimes, identified as "crimes against peace." But one of the judges, Radhabinod Pal of India, argued that all the defendants should be declared innocent of such charges. A two-and-a-half year judicial battle ensued between Justice Pal and some of his colleagues from other Allied countries, over how to put Japan on trial. Matters of national prestige and judicial authority were at stake. This is a fresh look at the proceedings; and it asks an important question anew, for our own time: what does it mean to pass judgment on a war?
