The Espionage Act 2018 (Cth) replaced Australia's four espionage offences with 27 new offences. The laws criminalise a very wide-range of conduct which involves ‘dealing' with information for the purpose of communicating it to a ‘foreign principal'. The laws' complex nature and uncertain scope is having a chilling effect on public interest journalism. The legitimate conduct of journalists and sources is at real risk of criminalisation under the laws.
